Terms of Service

1. Acceptance of Terms

By accessing or using the Quotly platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Quotly is a quote-generation platform that provides professional-grade estimation tools for home improvement and property maintenance services. The Service connects property owners with contractor-generated estimates and allows property owners to generate self-quotes using the same professional tools. Some contractors also accept card payments through Quotly for deposits and final balances. The services available through the platform may change from time to time.

3. User Accounts

You may register as a Property Owner or a Contractor. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information during registration and keep it up to date.

4. Quote Accuracy Disclaimer

All quotes generated through Quotly are estimates only and are not guaranteed. Actual project costs may vary based on site conditions, material availability, labor market changes, and other factors not captured during the quoting process. Quotly is not responsible for differences between estimated and actual costs.

5. Payments

Quoting and booking are free. Quotly does not charge property owners or contractors any fee on payments, and takes no share of them.

Who you pay. When you pay by card through Quotly, you are paying the contractor. Payments are processed by our payment provider, Stripe, and go directly to the contractor's Stripe account. Quotly never holds your money and is not the seller of the work.

Deposits. Only some services (currently driveway installation, fencing, and gutter installation) can require a deposit. The contractor sets the deposit as a percentage of the quote, up to 50%. Deposits pay for materials: paying one clears the contractor to purchase materials for your job right away. Once materials are bought, refunds may not be available and should be coordinated directly with the contractor. Deposits are also covered by the Quotly Deposit Guarantee.

Final balance. When the contractor marks a job complete, they may request the remaining balance through Quotly. The balance is the quote total minus anything already paid through Quotly. If the quote total changes (for example, an approved revision), open payment requests are updated to match.

Paying outside Quotly. A contractor may instead collect payment directly (cash, check, or another method). Payments made outside Quotly are solely between you and the contractor; Quotly cannot verify, refund, or recover them, and the Deposit Guarantee does not apply to them.

Refunds. Refunds are handled by the contractor. If a payment arrives for a bill that was already paid, withdrawn, or changed, Quotly refunds it to your card automatically. Nothing in these terms limits your card issuer's dispute rights.

Quoted prices. The price of an instant quote is calculated by Quotly's servers from the contractor's own rates and the details you provide. If those details turn out to be inaccurate, the contractor may revise the quote, which you can accept or decline.

6. Contractor Independence

Contractors listed on Quotly are independent third parties. Quotly does not guarantee contractor availability, licensing, insurance, or the quality of their work. Quotly is not a party to any agreement between a property owner and a contractor. Any disputes arising from work performed must be resolved directly between the parties involved, except as described in the Deposit Guarantee.

7. Contractor Obligations

Contractors agree to provide accurate pricing information within their calculators, to respond to leads generated through the platform in a timely manner, and to maintain any licenses or certifications required by their jurisdiction. Contractor tools on Quotly are provided free of charge.

Contractors who accept payments through Quotly are the merchant for those payments and are responsible for refunds, chargebacks, Stripe's processing fees, and any taxes on what they collect. Payment processing services for contractors on Quotly are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to operate as a contractor on Quotly, you agree to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of Quotly enabling payment processing services through Stripe, you agree to provide Quotly accurate and complete information about you and your business, and you authorize Quotly to share it, and transaction information related to your use of the payment processing services provided by Stripe, with Stripe.

8. Limitation of Liability

To the fullest extent permitted by law, Quotly shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you have paid to Quotly in the 12 months preceding the claim. Payments made to contractors through Quotly are not payments to Quotly. This section does not limit Quotly's commitments under the Deposit Guarantee.

9. Termination

Quotly reserves the right to suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion, with or without notice. You may delete your account at any time by contacting us.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts located in King County, Washington.

11. Changes to Terms

Quotly may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
